Dealing with visa issues in the UK can be tricky. If your visa application has
been refused while you're in the UK, or if you're unhappy with the conditions of
your permission to stay, there might be a way to get it looked at again. This is
called an Administrative Review.
What is an Administrative Review?
It's basically a check to see if the Home Office made a
case working error when deciding on your visa. A different person will review the decision to see if any mistakes were made in applying the rules or guidance.
Are you eligible for a review?
- You are in the UK.
- You applied in the UK.
- Your application was refused, OR it was granted but you're unhappy with the conditions.
How do you apply?
You'll need to
apply online. It costs
£80.
When is the deadline?
- You must apply within 14 days of getting the decision.
- If you were detained when you got the decision, it's 7 days.
How long will it take?
It can take
12 months or more to get the result. The Home Office will contact you after 6 months with an update.
Can you ask for another review?
Generally, no. However, if the first review finds new reasons for the original refusal, you might be able to apply for a second one.
What if you want to stop the review?
You can
withdraw your request by emailing the Home Office. But the
£80 fee will not be refunded.
Important things to keep in mind:
- The review looks for errors in how your case was handled.
- A different person will conduct the review.
- If your visa has expired, you will usually not be removed while the review is ongoing.
- If you make a new visa application, your administrative review will be cancelled.
- You cannot use an administrative review to apply for a different type of visa.
Understanding the Administrative Review process can help you if you face issues with your UK visa while in the country. Make sure to act within the time limits and understand what the review can and cannot do.
