What is the UK Spouse Visa?

  • The UK Spouse Visa, also called the Partner Visa, allows non-UK citizens to reside in the UK with their British or settled partner.
  • It falls under the UK Family visa category and allows holders to work or study without restrictions.
  • A UK Spouse Visa is based on an individual's right under Article 8 of the European Convention of Human Rights.
  • The UK Spouse Visa permits:
    • Living, working, and studying in the UK.
    • Applying for Indefinite Leave to Remain (ILR) and, ultimately, British citizenship.
  • The spouse seeking entry to the UK must be granted entry clearance before arrival.
  • If you apply as a fiancé(e), you will be granted entry for six months to marry. Following the marriage, you will need to apply for a Spouse Visa.
  • The initial Spouse Visa is valid for:
    • 33 months if applying from outside the UK.
    • 30 months if applying from within the UK.
  • Extensions are available for a further two and a half years, bringing the total stay to five years. After five years, individuals are eligible to apply for ILR.
