Optimizing Appeals: Understanding the Admission of Additional Evidence at Appellate Stages in Legal Proceedings

Application for taking additional Evidence on record at an appellate stage, even if filed during the pendency of the appeal, us to be heard at the Time if final hearing if the appeal at a stage when after appreciating the evidence in record, the court reaches the conclusion that additional Evidence required to be taken in record in order to pronounce the judgment or for any other substantial cause.

Example: When the defendant in a suit based upon promissory note had knowledge about the opinion of the finger prints expert but intentionally withheld the same, the suit having been decided against him, he was not entitled to adduce the evidence at the later stage of appeal when he had sufficient opportunity to exhibit the report in the trial court.
